I. The notification referred to in Article 4 (3) of Regulation (EU) 2023/1114 of 31 May 2023 on markets in crypto-assets shall be sent to the AMF in accordance with the procedures set out in an instruction.

II. - On the basis of this notification, the AMF may decide that the public offering of crypto-assets does not qualify for the exemption provided for in Article 4 (3) (d) of Regulation (EU) 2023/1114 of 31 May 2023 on markets in crypto-assets. In such cases, it will adopt a reasoned decision, which will be notified in accordance with the conditions laid down in an instruction.
