I. - Upon receipt of an application for authorisation as referred to in Article 62 (1) of Regulation (EU) 2023/1114 of the European Parliament and of the Council of 31 May 2023 on markets in crypto-assets, the Autorité des Marchés Financiers shall inform the Autorité de Contrôle Prudentiel et de Résolution thereof and forward it the information received in connection with the application.
II. - In order to assess the completeness of an application pursuant to Article 63 (2) of the said Regulation, the Autorité des Marchés Financiers must obtain the opinion of the Autorité de Contrôle Prudentiel et de Résolution on compliance with the requirements set out in Article L. 54-10-7 I 3 and 4 of the Monetary and Financial Code. Within ten working days of receiving this information, the Autorité de Contrôle Prudentiel et de Résolution will inform the Autorité des Marchés Financiers whether it considers the application to be complete as regards compliance with the aforementioned requirements.
III. - If the Autorité des Marchés Financiers considers that the application is not complete, it shall ask the applicant to provide the missing information and set a deadline by which the applicant crypto-asset services provider must provide any missing information.
IV. - Upon receipt of a complete application, the Autorité des Marchés Financiers shall evaluate this and forward it within five working days to the Autorité de Contrôle Prudentiel et de Résolution for an opinion on compliance with the requirements set out in Article L. 54-10-7 I 3 and 4 of the Monetary and Financial Code. The latter shall send its opinion to the Autorité des Marchés Financiers within fifteen working days of receipt of the complete file by the Autorité de Contrôle Prudentiel et de Résolution. If the latter considers that additional information is needed for it to issue its opinion, it shall inform the Autorité des Marchés Financiers by the tenth business day at the latest.
The Autorité des Marchés Financiers will send the applicant crypto-asset services provider a written list of the additional information necessary for the evaluation to be successfully carried out.
As soon as it receives the information requested, the Autorité des Marchés Financiers shall, where appropriate, forward to the Autorité de Contrôle Prudentiel et de Résolution the information received in relation to compliance with the requirements set out in Article L. 54-10-7 I 3 and 4 of the Monetary and Financial Code.
V. - The Autorité des Marchés Financiers shall inform the Autorité de Contrôle Prudentiel et de Résolution whether or not authorisation has been granted.
