I am no longer a manager of one or more AIFs. Do I have to pay the fixed fee?
If you are no longer the official management company for one or more AIFs, check the date of change of manager. If the date is later than 1 January of year N, then you are liable for the fixed fee for year N. If the date is earlier than 1 January of year N, ask your supervisory authority to confirm to you that it has sent the information to the AMF. You can possibly inform the AMF of this by writing to the email address fixedfees [at] amf-france.org, indicating as the subject "Incorrect invoicing data".
The contact data or name of the company are incorrect. How to ask for them to be changed?
If you note that the contact data or name of the company are incorrect, ask your supervisory authority to confirm to you that it has indeed sent these changes to the AMF.
The invoiced AIF has never been marketed in France. Do I have to pay the fixed fee?
The fixed fee is payable for the marketing authorisation, and not for the actual activity. Accordingly, although you may never have marketed the AIF in France, you are liable for the fixed fee so long as the AIF is authorised for marketing in France.
The invoiced AIF is no longer authorised for marketing in France. Do I have to pay the fixed fee?
If the AIF is no longer authorised for marketing, check the date of termination of marketing. If the date is later than 1 January of year N, then you are liable for the fixed fee. If the date of marketing authorisation is earlier than 1 January of year N, ask your supervisory authority to confirm to you that this information has been sent to the AMF.
Moreover, we would remind you that in order to cease marketing a foreign AIF in France, you must provide the AMF with confirmation that there are no longer any French investors. Without this declaration, the AIF remains authorised for marketing. However, if you have made this declaration, you can inform the AMF of this by writing to the email address fixedfees [at] amf-france.org, indicating as the subject "Incorrect invoicing data".
The invoiced AIF was authorised for marketing in France by mistake. Do I have to pay the fixed fee?
If the AIF was authorised for marketing in France by mistake, ask your supervisory authority to confirm to you that this information has been sent to the AMF. Your supervisory authority must confirm to the AMF that the application for marketing in France was sent by mistake. Without this confirmation, the fixed fee remains payable.
