The Autorité des marchés financiers (AMF) and the Autorité de contrôle prudentiel et de résolution (ACPR) would like to warn the public

The Autorité des marchés financiers (AMF) and the Autorité de contrôle prudentiel et de résolution (ACPR) would like to warn the public about a number of unauthorised online investment services in France for derivatives whose underlyings include crypto assets.

On 22 February 2018, the AMF published an analysis on its website concluding that crypto derivatives may be legally considered financial contracts. As such, the AMF and the ACPR have decided to jointly publish a blacklist with the websites that offer crypto derivatives without authorisation in France.

Additionally, it is worth mentioning that as of 1 August 2018, the European Securities and Markets Authority (ESMA) will be temporarily restricting the marketing, distribution and sale of CFDs to retail clients in the European Union, including CFDs on crypto assets, within the terms and conditions set out in decision 2018/796 of 22 May 2018.

A list of all unauthorized sites to offer trading of cryptocurrency derivatives is available in the site on the AMF's website.

These websites may change very quickly and this list is not intended to be exhaustive.

To ensure that the intermediary offering banking or financial products or services is authorised to operate in France, you can view the register of financial agents (https://www.regafi.fr) or the list of authorised intermediaries in the financial investment advisor (FIA) or participating investment advisor (PIA) categories (https://www.orias.fr/search).  

If the intermediary in question is not on these lists, we strongly recommend that you should not make use of their services, as they are in breach of the applicable legislation and are not required to comply with basic rules of investor protection, information disclosure and claims handling.
