Jean Gaeremynck becomes Chairman of the AMF Enforcement Committee
Jean Gaeremynck has been elected as Chairman of the Enforcement Committee of the Autorité des Marchés Financiers (AMF). He will succeed Marie-Hélène Tric. Didier Guérin will chair the second section of the Committee.
After the partial renewal of the Enforcement Committee following the departure of four members, Marie-Hélène Tric, Bruno Gizard, Christophe Lepitre and Bernard Field, and after the renewal of two members, Sophie Schiller and Edwige Belliard, the newly-formed Enforcement Committee elected its new chairman at its first meeting on 22 September 2021. Jean Gaeremynck, Section President at the Conseil d’Etat and member of the Enforcement Committee since April 2016, takes over from Marie-Hélène Tric.
As allowed by the Monetary and Financial Code, the Committee is organised into two sections, each composed of six members and chaired by one of the judges of the Conseil d’Etat or the Court of Cassation. To decide on a case, the Committee may meet in plenary session or in a section meeting.
The chairman of the Enforcement Committee was elected by the committee members from among the four judges appointed by the Vice-President of the Conseil d’Etat and the Chief Justice of the Court of Cassation. Jean Gaeremynck will therefore chair plenary sessions as well as the sittings of the first section. The members of the Commission also elected Didier Guérin, Honorary Chamber President of the Court of Cassation and member of the Enforcement Committee since February 2018, as Chairman of the second section.
About the Enforcement Committee
The Enforcement Committee, which is made up of judges and professionals, has total freedom to make decisions. It can impose sanctions on any person or company whose practices contravene laws and regulations that fall within the jurisdiction of the AMF. It ratifies settlement agreements signed by the Secretary General and respondents. And it takes part in the AMF’s educational efforts by clarifying financial regulations when explaining its decisions.
