Appointements to the AMF Enforcement Committee

By an order of the Minister for the Economy, Finance and Industrial and Digital Sovereignty dated 13 February 2024, published on 20 February 2024 and by decision of the other competent authorities, the Enforcement Committee of the Autorité des Marchés Financiers (AMF) has been partially renewed. The Committee welcomes 4 new members.

Six mandates of the twelves members of the Enforcement Committee had come to end this year.

The four new members are: 

  • Jean-Claude HASSAN, appointed by the Vice-President of the Council of State,
  • Xavier SAMUEL, appointed by the first President of the Court of Cassation,
  • Sophie LANGLOIS, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
  • Aurélien SOUSTRE, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty.

Have been reappointed:

  • Anne LE LORIER, by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
  • Ute MEYENBERG, by the Minister for the Economy, Finance and Industrial and Digital Sovereignty.

The composition of the AMF Enforcement Committee was published in the Official Journal on 27 February 2024.

The new membership of the Enforcement Committee  

Ms. Edwige BELLIARD, appointed by the Vice-President of the Council of State,
Mr. Jean-Claude HASSAN, appointed by the Vice-President of the Council of State,
Ms. Valérie MICHEL-AMSELLEM, appointed by the first President of the Court of Cassation,
Mr. Xavier SAMUEL, appointed by the first President of the Court of Cassation,
Mr. Frédéric BOMPAIRE, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
Mr. Alain DAVID, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
Mr. Aurélien HAMELLE, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
Ms. Sophie LANGLOIS, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
Ms. Anne LE LORIER, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
Ms. Sophie SCHILLER, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
Ms. Ute MEYENBERG, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty,
Mr. Aurélien SOUSTRE, appointed by the Minister for the Economy, Finance and Industrial and Digital Sovereignty.

At its next meeting, the Enforcement Committee will elect its chairman from among four judges appointed by the Vice-President of the Council of State and the first President of the Court of Cassation. 

An independant committee

Independent from the AMF Board, the Enforcement Committee includes 12 members:

  • Four judges: two councillors of the Council of State appointed by the vice-president of that body and two Court of Cassation trial judges appointed by the first president of that Court;
  • Six professionals with legal and financial expertise and experience, appointed by the Minister for the Economy, Finance, Industrial and Digital Sovereignty and after consultation with organisations representing industrial and commercial companies whose securities are offered to the public or listed on a regulated market;
  • Two representatives of the employees of finance sector firms, appointed by the Minister for the Economy, Finance, Industrial and Digital Sovereignty after consultation with representative labour unions.

Members have a five-year once-renewable term of office that runs from the first committee meeting attended. 

About the Enforcement Committee

The Enforcement Committee, which is made up of judges and professionals, has total freedom to make decisions. It can impose sanctions on any person or company whose practices contravene laws and regulations that fall within the jurisdiction of the AMF. It ratifies settlement agreements signed by the Secretary General and respondents. And it takes part in the AMF’s educational efforts by clarifying financial regulations when explaining its decisions.
